Loanplaced terms of service
1. Acceptance of these terms
By accessing loanplaced.com or using any Loanplaced service, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Loanplaced services.
2. Description of service
Loanplaced is a licensed loan comparison and placement platform. Loanplaced is not a direct lender. Loanplaced does not guarantee that any particular lender will approve your application, nor that you will receive any specific rate or term.
3. Eligibility
To use Loanplaced you must be at least 18 years old (19 in AL and NE), a U.S. citizen or permanent resident, and have a valid Social Security number. Certain services have additional eligibility requirements disclosed at the point of application.
4. Your responsibilities
- You will provide accurate, truthful information on any Loanplaced application.
- You will not submit fraudulent applications or misrepresent your identity.
- You will maintain the confidentiality of any account credentials.
- You will not use Loanplaced services for any illegal purpose.
5. Loanplaced's role
Loanplaced facilitates matching between borrowers and lender partners. The loan itself is a contract between you and the specific lender. Any dispute over loan servicing, credit reporting, or funds disbursement is between you and the lender.
6. Rates and offers
Rates displayed on Loanplaced pages that have not been personalized to you are indicative and based on Loanplaced's approved‑offer data for the most recent complete quarter. Rates from lenders are subject to change until you formally accept and lock in a specific offer.
7. Intellectual property
All Loanplaced content — text, graphics, logos, code — is owned by Loanplaced or licensed to Loanplaced. You may not reproduce, distribute, or create derivative works without written permission. "Loanplaced" and the Loanplaced logo are trademarks of Loanplaced, LLC.
8. Third‑party links
Loanplaced links to lender websites and third‑party resources. Loanplaced is not responsible for the content, terms, or practices of any third‑party site.
9. Disclaimers
Loanplaced content is educational and does not constitute financial, tax, or legal advice. See our disclaimer for full detail. Loanplaced services are provided "as is." To the maximum extent permitted by law, Loanplaced disclaims all warranties, express or implied.
10. Limitation of liability
To the maximum extent permitted by law, Loanplaced is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Loanplaced's total liability for any claim relating to these Terms is limited to $500 or the amount of fees paid to Loanplaced by you in the 12 months preceding the claim, whichever is greater.
11. Indemnification
You agree to indemnify Loanplaced against any claim arising from your breach of these Terms, your misuse of the service, or your violation of any law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict‑of‑laws principles. Any dispute will be resolved by binding arbitration under the American Arbitration Association's Consumer Rules, except that either party may bring a claim in small‑claims court where jurisdiction permits. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms.
13. Changes
Loanplaced may update these Terms. Material changes will be announced with 30 days' notice. Continued use after the effective date constitutes acceptance.
